V5C missing

So found a cheap Van @ £480 however found out today the guy selling it doesn't have the V5C. It turns out that when he bought it a year ago the guy either didn't send of the main part of the doc or the guy selling it has lost it or never received it and he never chased it up. He has the V5C/2 the little green slip from when he bought it but this would of course be from the log book the guy who sold it to him had. Anyway question is would I get away with applying for the V5 using the green tear off that the current owner has and a V62 without paying the £25.00 fee or do you think the DVLA will charge stating the original was lost.

You should be able to do it online by taxing with the reg and v5c2 with no cost, they should send you a v5
