COURT OF ENQUIRY - Please read carefully

FINDINGS OF COURT OF ENQUIRY 841 COURT OF ENQUIRY 841 - TO INVESTIGATE THE ACTIONS OF MRS DUNN AT THE VAAL OVAL RACEWAY EVENT HELD ON 6TH MAY 2006. HELD IN THE MSA BOARDROOM, 108 MONZA CLOSE, KYALAMI BUSINESS PARK AT 19H00 ON WEDNESDAY 7TH JUNE 2006

PROCEEDINGS

No objections were raised against the composition of the court. Having heard evidence provided, the court finds as follows:

FINDINGS OF THE COURT

1. The reported behavior from the competitors family and crew is unacceptable. This is especially serious as it was the official scrutineer Mr. P.P. Prinsloo that was being abused by both the mother and father of the competitor.
2. In terms of GCR 172 (x) the abuse of officials is unacceptable and the competitor is reminded that he is responsible for his pit crew. Their actions, particularly the exposing of Mrs. Dunn’s posterior to at least fifteen people brings Motorsport into disrepute in terms of GCR 172 (v).
3. Bearing in mind the seriousness of their actions both the competitor Basil Dunn and his father (Basil Dunn Snr) are penalized by the withdrawal of their competition licences from all forms of Motorsport for a period of six months from the date of these findings.
4. These penalties are applied in terms of GCR 202 and 220.


No costs are awarded in the above, and all parties are reminded of their right to appeal. These findings were read at 20h00.

I reckon they got a 'bum' deal although I think they will have to sit back and 'anal'yse the cost of such a mistake. They will certainly be 'bottom' of next years championship unless a m'ass' appeal can overturn the verdict!

Once the court has made the decision is that the 'bottom line' or can they appeal.

It was a shi11y thing to do.

She probably 'ass'umed nothing would come of it.

COURT OF ENQUIRY 869
TO INVESTIGATE THE ACTIONS OF COMPETITOR GARY PETERSEN AT THE SUPERMOTO EVENT HELD AT VEERENIGING ON THE 7TH OCTOBER 2006. HEARING HELD AT 18H00 ON THURSDAY, 2ND NOVEMBER 2006 IN THE MSA BOARDROOM, 108 MONZA CLOSE, KYALAMI PARK.

Gary Petersen - Competitor
Michael Kok (Jnr) - Competitor
Brian Capper - Competitor
Gail Petersen - Witness
Michael Kok (Snr) - Witness
Everitt Murray - Witness
Allan Wheeler - MSA Sporting Manager: Non Circuit


Evidence was presented by the Clerk of Course and all parties concerned and witnesses.

Having heard all the evidence, the Court finds as follows:

Mr Petersen admits to starting a verbal altercation with Michael Kok (Jnr). Mr Michael Kok (Snr) intervened and the verbal altercation escalated. This, unfortunately, took place in full view of spectators and fellow competitors.

This behaviour is unacceptable and in full contravention of GCR 172 iv and vi.

The Court therefore dictates that, taking into consideration Mr Petersen’s previous sentence, his licence is to be withdrawn for 12 months.
The re-imposition of the life ban is to be suspended for a period of 5 years on expiry of the 12 months. Should he transgress any GCR’s and SSR’s during this 5 year period, the previous life ban will be re-instated.

The Court further finds that Mr Kok (Jnr) be imposed with a fine of R1000.00 for the behaviour of Mr Kok (Snr).

All parties are reminded of the right to appeal in the National Court of Appeal.

These findings read at 18:45 on 2nd November 2006.
