That's a common enough thing sellers do when they have no stock, rather than end and pay for a relisting they up the price and keep the add live, then reduce the price again when they get stock

Common seller practice when stock is depleted, saves relisting fees.

I suppose they would have to prove it, I dont think there is any stipulation on what you can charge on eBay.
