come on everyone celebrate how long its took

as Ive just purchased the part built MK Indy of ebay

and theres a ZX12r engine already in my kitchen

doesnt look good anymore its gone higher than the agreed price so ill be having my deposit back oh well

no its gone up more on ebay than the agreed price(convenient?) he hasnt asked for more hes confused as to what to do

hes deciding today we agreed a price though I dont haggle after that

If he agreed a price with you before the end of the sale, that's his tough luck. A deal is a deal. In this country a verbal contract is legal and binding.

If the auction still has time to run then why does he not end the auction early (seller option on ebay) which cancels all bids. If he's decent sort he should do this and he would then still be able to go through with the deal with you!
However you do tend to see people's true colours when dealing through ebay!

as much as I appreciate the comments I really couldnt imagine going to court over a part built MK indy

Ive had my deposit back now anyway
ill just wait for the next one

It's not a verbal contract - presumably there's some email correspondence which proves any agreement. A price has been agreed and ZXR has given consideration towards the contract in the form of a deposit. That means that the contract is formed at the price agreed and the seller needs to provide the goods to form his consideration towards the contract to complete the execution (plus the rest of ZXR's cash!).

You'd never get anywhere though - lawyers are just a little too busy with bigger fish to fry (like any 'no win, no fee' case going!)

I'll sell you my unfinished Indy for £7500 though
