so you agreed a price, paid a deposit and then he claims more money after you paid the deposit.

If he agreed a price with you before the end of the sale, that's his tough luck. A deal is a deal. In this country a verbal contract is legal
and binding.
Tell them about the bent treacle edges!

If the auction still has time to run then why does he not end the auction early (seller option on ebay) which cancels all bids. If he's decent
sort he should do this and he would then still be able to go through with the deal with you!
However you do tend to see people's true colours when dealing through ebay!

It's not a verbal contract - presumably there's some email correspondence which proves any agreement. A price has been agreed and ZXR has
given consideration towards the contract in the form of a deposit. That means that the contract is formed at the price agreed and the seller needs to
provide the goods to form his consideration towards the contract to complete the execution (plus the rest of ZXR's cash!).
You'd never get anywhere though - lawyers are just a little too busy with bigger fish to fry (like any 'no win, no fee' case
going!)
I'll sell you my unfinished Indy for £7500 though
