My best friend is a solicitor......under current UK law no company can REFUSE to give a reference..nor can they give a bad one.
I get a friend to phone up from time to time just to check on what they are saying.
And knowing the company in question they wouldn't take it to court anyway they would settle.
Who the f**K tightened this up!

But you can always use the reference:

i have given references to people that have worked for me in the past.
the way you deal with the w87kers is to give a report in very basic terms. there are ways of saying things that make it plain that somewon is useless
without spelling it out.
htf can it be wrong to give the facts?
if they are true, and you said things like
high level of absenteeism
not one of the most efficent workers
doesnt respect management
blah de blah
how can that be illegal?

How f**ked up is it that you can not tell someone that the person they are thinking of employing is an arse?

course you can tell them ..... you just have to be creative.
I mean who would you hire?
"Peter has been an excellent employee. We are very sad to see him go and would hire him again. He is very dedicated often working long hours to
complete important projects....blah blah blah"
or
"Peter was employed by us between the dates x and y. etc"

A few weeks ago I was asked if I would give a reference to our previous storeman.
I replied that, all I would say about him was that he was not allowed on our premises anymore,he didn't get the job!Strangely he did not
ask about his timekeeping after that,or his honesty, perhaps a good job he didn't!
I have written evidence concerning both!
