Where do I stand!!!!

Hi

any advice please I searched high and low for a specific product, which most are into the Łk a few are about 600 quid and after some searching I couldnt find it better than this I also couldnt find cheaper one anywhere else? ie it was as if this company was the only ones selling it, ?? also if you put the name into google it didnt find that item anywhere else

anyway I bought it for 610 quid it came and its excellent. full credit to the blokes service(wanka)

But Ive been ripped big style(wasnt to know)

The thing as far as I can see isnt called anything like what he calls it on his website... its totally different

and now i KNOW the proper name its bleeping 349 quid delivered elsewhere.. it would have been impossible to find without knowing the proper name as its not a specific make!

349 quid!!!

what can I do its got guarantee etc so hes all legit

thanks chris

If you boiught it on-line, Distance Selling laws apply, which give you a certain amount of time to return the product if its unwanted. You have to act quickly though, and may have to pay a handling/stocing fee to the guy.

Im not sure of the details, someone else here is bound to know more than me.
Or maybe google Distance Selling laws.

If the goods are not faulty then you're stuffed. It is up to the seller's descretion whether he accepts the goods back or not... he is more than entitled to refuse of course. Grovelling is always a good place to start as you have more to loose than he does.

I think (but am willing to be corrected) that you'll find distance selling laws also apply to telephone orders.

I think you are right. Anything you didnt buy in person, i.e. bought by mail order is covered by the distance selling regs.

Try Trading Standards.

Goods must be described accurately and properly, with no intention or otherwise to mislead. Sale of Goods Act. Year???

If the description is not concise, then he's worthy of a visit from Trading Standards officers.

Most County Councils have a Trading Standards Dept.

Youve got 7 days to contact him by a written letter fomr recieving the goods, requesting that all money be refunded and he must arrange to collection of the item(s) in question.

heres a few links of interest, also if you do a search their is a .doc template for you to send to fill out and send to the guy, make sure you get it sent first class and a signed for delivery to make sure he got it.

We have to obey some distance selling rules and one of the points we have to 'obey' is:

Right of cancellation - a consumer ordering products by telephone or by
letter/e-mail/fax has a right to cancel the order up to 7 business days
from the day after delivery, whether or not the product is defective. The
only exceptions to this are if a product has been custom made for the
consumer or if it is a type of product which could have deteriorated e.g.
bags of cement. Make sure the consumer understands that they have this
right of cancellation, but that if they want us to collect the products,
they will be liable for our costs, which in practice will be a 15%
restocking charge.

(The 15% is something we decided upon so will vary from place to place)

Baesd on this, I believe, you can return it for a refund (full price less a handling charge a tthier discression) without any argument from them.

The other thing is did you pay by cresdit card? If so contact the credit card company as they will (should) back you if you have a case!
