Well before writing a long drawn out letter I thought i'd post on here and see what other people thought, or any advice.

Whilst at work today I recieved a ticket for:

"01 Parked in a restricted street during prescribed hours"

I never saw a sign saying the whole street was restricted and presumed it was only where the lines are, so parked as such:

Am I just feeling had done by or do other people think i've got a case?.

I'm planning on appealing that there was no line or it was obscured where I was parked and looked like it had finished before what appears to be this little parking bay ( there were also other cars to the left when I arrived).

I'm planning on getting these photo's printed out from the memory card so they are proper photo's rather than digital ones that could appear doctored.

Certainly made getting out of bed to go to work this morning feel pretty pointless!

yep send the pics off, theres no chance in court.

Looks pretty good bet, even making them do paperwork to deal with your objection is wothwhile!

The only technicality I think they may use is term "restricted street" in the offence.

This would maybe class the whole street as a restricted area.. but I never saw any signs saying this upon entering the street, infact the only sign I did see was the 1 in the picture that was partially obscured by the trees and the yellow lines where obvious.

Imight be wrong, cos my eyes are half closed...
I can not see a return on the single yellow line in the pic. But law all lines must be clear, continious and capped (so is clear where the restriction ends).
Not sure it helps if it is in a restricted area, but thats a technicality id throw in!

It confused me thinking I had posted but hadn't!

I'd agree- looks like the yellow line just tapers out. The bit you're parked in looks very much like a parking bay.
The sign is obscured but probably not enough to say it was hidden (after all the yellow lines were there)....
Send off the photos- nothing to lose after all.....

If you scrape away the leaves etc you will probs find remains of yellow line underneath. To the left of the van there appears to be a line there which presumably links up (or did ages ago when first painted and the bushes were little cuttings).

Best defence is the ambiguity of the lines id say. Just threw the bit above in in case they raise it and you need to defend without prep.

From above it's fairly clear that the line probably goes right round the turning bay under the mud and leaves, but given that it's completely obscured with crap you may have a defence. As pointed out above though, the ends of yellow lines should always be capped; since there is no cap visible it could be argued that you could tell the line continued under the mud.

I'd write a short letter attaching the aerial shot and see what they say.

Is the end of the road a dead end? Could it be construed that you parked in a turning circle and thereby caused an obstruction - maybe this is what they mean by a restricted area.

Might be worth checking highway code etc.

Were you there on business in the firm's van? It could help your case if you were parked there so as not to cause an obstruction of the main carriageway while unloading.

No T bar on the yellow line so the line is in fact worthless in the yes of the law. Write to them stating this with copies of the pictures in a pleasent manner and you should get a warning letter saying you've been let off this time but it won't work again.

If that sort of letter doesn't come back, go to court as the line needs to be continuous to be effective.

Just out of interest... how often do you take pictures of your van when parked, unless you have a feeling that you may be parked illegally?

Or have you gone back to the location and reparked in the same position, then took pictures. In which case, how do we know you have not obscurred the sign and covered the lines with leaves?

Just playing devil's advocate... as that is what the coucil will possibly do.

just tell that you made the pic for the gardner/landowner and that when arriveing at the car you found the note..
