not had this problem before but how do it tighten the nuts that hold top ball joint into upright? just keep spinning

Can you not put pressure onto the top of the ball joint so that it is held by friction in the taper and then tighten it?

Pry bar it down from by where that weight is on the wheel?

get someone to stand on the bone while you tighten the nut
Tie down strap around top and bottom wishbones, tighten gently!
Tighten it with a non nylock nut first, then remove and fit the nylock - a bit of a pfaff but always works.
A good belt with a rubber mallet is much faster and usually works.
Plank of wood, shove end inside wheel rim and lever the joint down into the taper.
large socket over the nut and then use a g clamp to press it home I would suggest another socket on the top applying pressur to the casting. Is the rod end the correct one if not this could be the problem as the taper may be wrong
+2 for the non-locking nut first then stick on the nylock afterwards.
