Possible Car Insurance Scam - Thoughts Please??

I'm hoping there's a car insurance expert on here who can help with this one....


One of SWMBO's friends came round tonight a bit puzzled at a letter she received from her car insurance company today...

... apparently, she was involved in an accident on the Dartford crossing last week at approx 18:45.

She was indeed passing over the Dartford crossing on said day, about an hour before hand (she can prove this with the dart tag), but never had any accident.

Apparently, the letter says that she hit some fella up the back. There's no police report, because there was no accident.

So, my question is, where does she stand with this?

It's clearly a scam - Unfortunately, it's going to cause SWMBO's pal a load of unnecessary stress while the insurance companies deal with it over the coming weeks, and a worse case scenario, she looses her no claims.

Is it a case of the insurance company having to prove it happened?
It's her word against his. I think it's a bit harsh if she looses her no claims over something she didn't do. Should she get the police involved?

Any Ideas?

Surely a photo of the front of her car and dart tag info will help clear her

As she can prove she wasn't there at the time I would say the insurers will tell the other side to swivel.

Could be someone running around on cloned plates using her registration?

This a a scam, just like they did on York Road, Leeds, years ago.

Someone would note a car on the road and would then report that it had collided with their, already bent, car.

I thought this, then it would just seem a bit odd that she was in the same place only a hour earlier... It's clearly a Scam.

I agree, but i was really after some official channel she can counter report this scam through.

Would it be worth contacting the police ?

It might be that this has been going of for awhile on this road or in the area ?

Report it, do not expect anything as they will cry civil matter but get it logged and a reference number.

I was once accused of taking off a wing mirror of a transit van when our paths crossed, bit hard to work that out as I was in had fiesta where the roof was lower than the mirror!

I was also in Milan at the time, the car parked at Stanstead airport, one letter and I never heard anymore, do not sweat it.

She doesn't have to prove anything, the burden of proof is with the accuser.

It happened to my wife, she was supposed to have rear ended someone on the M1 whilst we were in Greece, one call to the insurance and we heard nothing else about it.
