Legalities

As there are a few mot testers on here I look forward to the answers

OK I'm contemplating a landrover 110 county which by all accounts so far comes in 8,9,11 and 12 seat configuration.
The one I am currently looking at is listed as a 12 seater on the v5. BUT it only has a class iv MOT ( which covers up to 8 seats )

Now is it legal at all with this mot ?

If no then why did the tester not pick up on it ?

Why when entering the reg into the computer for the mot did it not automatically come up with the correct class? ( or can it be overidden?

3 How many young farmers lasses and lads are driving 12 seaters ( on the V5) when their licence only covers them for up to 8 seats? Are they all breaking he law? or is it "OK" untill they have a prang or a claim.

legally i'm not sure what the story is (they pre-date half the modern rules) my dad couldn't get a clear answer so decided to avoid the whole issue just before I turned 17 and replaced the rear benches with 2 front facing seats (with belts) then got the v5 changed to show 8 seats



12 seats is a bit of a joke anyway

2 proper seats in the front + the comedy one over the gearbox (mind you could be fun putting the handbrake on when I was a bit yonger with a girl sitting in the middle )

3 in the middle row

2 side facing benches in the back - not really enough room for 2 peopl each side never mind 3 (and no seatbelts in the back either! )

You got to be carefull with stuff like this, much better to be safe than sorry. A friend had a LWB van that turned out to be legally a HGV or something simillar and he'd been driving for 2 years without a lisense or valid insurance as a result because he didn't know (Which is his fault, but you gotta feel sorry for him) and his insurance company knew this the whole time but at no point attempted to tell him they'd sold him a duff policy.
