Does this seem backwards?

I remember a while back someone asking about claiming compensation for pothole damage, for some reason this council says that if they know about it
they don't have to pay out? I honestly thought that if they knew about it but didn't do anything about it then it should be easier to
claim?

I tried to claim off the council for this once, after a lot of emails back and forth they put me through to their insurers who said, 'if you can
prove that the council has to pay for the damage then we will pay it'

Same here, bent alloy on my Alfa £300 for a new one, pot hole caused by a badly repaired old hole, lost of pictures etc. The reply I got back included
a printout of all of the pot holes that had been identified with the reply, if it ain't on the list we are not liable. So, moral of the story,
if you hit a pot hole get a mate to call it in and then claim after. :-) or better still if you se a pot hole report it immediately, the more that are
reported the less the councils will get away with.

That's the thing, I agree with you in that if they don't know about it they may be able to worm their way out of it. But the newspaper
article suggests they can get out of it if they DO know about it.

Knowing about it means nothing, they have a legal obligation to monitor the road conditions (different schedules depending on road type). If they know
about it they have been made liable if they do not fix it within a reasonable space of time (a week seems normal).
They will tell you anything they can to get out of it, it's your responsibility/choice to push it.

I was always one to whinge about the state of the road and all the potholes, then one day I did the sensible thing and reported the potholes rather
than whining about them. I reported one outside of my house and literally within a couple of hours a little man arrived and filled it in .....
obviously if it is reported then they are obliged to fix it so the more people who do this the better.
If you see one go to https://www.gov.uk/report-pothole/birmingham and report it. Don't think of it as doing their job for them ..... you may
prevent a bad accident .... think how bad you would feel if a biker hits one and you had known about it for a while without reporting it !!!!
