I think ive been stung, I sold a set of r1 carbs to a guy on ebay last month. he pays by cheque, then once he recieved the carbs he emails to say there f##ked. (I never gave them a good check over to be honest) so i send him his money back plus a bit to cover the return postage. Trouble is ive not got them back yet and i notice he sold a set 3 days ago on ebay. Needless to say ive got no come back via ebay as we both sent cheques which cleared. Now being a vandictive basturd of a man that i am for security reasons i photocopied his cheque for my business records and i also have his full name and address do i do the dirty as in apply for anything and everything in his name or go see him with the boys in tow.
what area does the other guy live ?
Norwich
You might get some compensation via the eBay dispute system or maybe contact the latest owner of the carbs and see what you can organise between
you
Just a thought...

is there no ne in the area on here willing to knock on the door and ask for the money or carbs back .
i'll be working down there in march if you cant find anyone to do it
graememk
is now
gangstamk
mate you should get your stuff back first then refund
Can't you just send him a letter explaining that you've noticed he's recently sold a set of carbs on e-bay and ask him where yours are.
It might turn out they were his to sell and your's are being returned in the post. Give him a chance to respond first and establish the facts
before deciding to take things further. If nothing else, it let's him know that you know where he lives

Shame he's not in Scotland otherwise a half hour with a lawyer could get his bank account arrested! His bank isn't a scottish branch is it?
Send an email to him asking when he is returning the carbs that you refunded to him because he said they were fkd and copy it to the guy who recently
bought carbs from him, not exactly the correct thing to do but would increase his headache factor considerably, post the replies here for us to have a
chuckle at!

When he ebayed (your carbs) how did he describe them, don't suppose he said they were f*****???
Report him to the police, it's fraud. Then the Norwich bizzies'll have to pay him a visit.
If he has ripped you off, report him to the police, then he will get his proper comeuppance. Either that or seek legal advice from a solicitor.
I dont live far from Norwich when I am at home, but sorry, I wouldnt say boo to a goose, so wouldnt be much good at getting anything out of him.
Whats his eBay ID?
David
I think Hellfire's idea is the best way to proceed.
Put your telephone number on the letter and ask him to get in touch within 7 days or you will take the matter further (don't say how though -
keep him guessing and worried).
Don't mention the carbs he sold - just ask where yours are.
Send it recorded delivery as well.
Pat...
Dave
if you need someone to pop round and collect them for you give me a shout
Two options...
1) Report to police - fraud
2) Go through the small claims court - this will probably require you to go to 1) first, though...
Personally, I'd go through the police, and if they prove ineffective, go buy a ski mask
And maybe borrow a big scary looking tatooed biker or 4 from somewhere
ps for legal reasons don't listen to me too much!!

If he has your goods, and your Money, and intends to keep both... Its THEFT.
Call the Police, you have the Ebay Adverts, and the proof.
Write to him, and keep a copy. I mean Real Writing in a Letter, Send it recorded delivery.
Say you have taken legal advice. (Dont say what)
Tell him to return your goods with 7 days or you will take the matter further through the courts.
He has sold your Carbs.. Thats selling property he does not legally own. ie like selling a car you have on Hire Purchase... just as illegal.
He is Scamming you, and its illegal. ie Theft.
Report to the police. You have acted in good faith all along.
Small Claims court in Norwich is another good bet.
Call Citizens advice for the legal situation / advice.
PS... Dont do anything stupid... Remember Norwich is Tony Martin Country...

At least crime is a bit lower since all that.
no crime has been comitted until your carbs dont come back. Dont prejudge him - its quite possible he had a different set to sell beforehand.
Im with hellfire and pat. If you steam in with accusations you will just fall out with him. If he says that he posted them and they must be lost,
that, IMHO, is when the balance of probability shifts against him. Until then, be reasonable.
The police will do sweet fa for anything committed on ebay. Unfortunately ebay are absolute nightmares to deal with and cause the police more hard
work than it's worth to them.
1st thing to do is what's already been stated. You can request his contact details from ebay, the automated form asks for the auction number and
his ID. It will email him a copy of your details but you will get his.
Give him a call and ask where you carbs are. If he doesn't have them then your only option will be small claims court.
The police will really not want to know.
If you want any advice on the u2u me as I've had to go this route before when someone did a chargeback with their credit card, stating non
delivery and paypal took the money from my account. Unfortunately the seller always gets screwed and I had to take the little scrote to court to get
my money back
