eBay dispute advice please

I recently bought some go-faster goodies (upper & lower inlet manifolds for my Duratec) on eBay and was charged £50 for delivery. I paid promptly and waited for delivery which came a little later than I expected and upon opening the bubble-wrapped inlet manifold, one of the vacuum take-offs was snapped off. This required a repair which would have cost me £30 (I got a quote) but I decided to repair it myself as time was short.

The seller said that he would contact Royal Mail and claim compensation, after which he would pass the refund onto me.

2 months later and I have still not had my refund and he refuses to pay me until he gets his comensation from RM.

Am I entitled to insist on him paying me regardless of whether he gets his compensation? I'm not really worried about the money - but the principle is another matter

I have filed a dispute with Paypal as suggested and when I emailed him to state my intentions (and to give him an opportunity to resolve the situation) he emailed back ..

"shame we cant meet face to face you dick big man over the computer.i will refund you when i hear from royal mail as i have told you.i will chase them up today.do you really think i give a sh1t whether you open a dispute and leave negative feedback. i dont really care. i will refund you once royal mail pay me the insurance. i charged you £50 because thats how much it cost me to send both items due to their weight. so shut up and grow up i will ring royal mail today.
i always keep to my word and you will get you money"

Me thinks he is beyond reasonable discussion

I have found there is a time limit on paypal claims, If you are going that way dont delay.

i sent a whole mini moto with royal mail and it cost £26!! (insured)


where did he get £50 figure from???

ask him for you postage recipt as its your insurance and you payed for it, and sort it your self

I had informed him that as we were not agreeing about the matter, Paypal would have to settle it.

I did wonder about having some fun with him though ......... something like

'Thankyou for your offer of oral sex but I must refuse as I am a happily married heterosexual. I will however pass your invitation onto a friend of mine, Maurice, who I am sure will accomodate you. I would like to add that I think you are very brave to broadcast your homosexual requests on eBay etc etc'

£50 seems extortionate for manifolds, you can get a whole set of wheels and tyres shipped for that much.

Report his abusive emails to ebay, especially if they arrived through the ebay system

They take a "very" dim view of that kind of thing

PS You should really name and shame the seller, I personally wouldn't want to deal with him....

During the logging of my Paypal dispute they stated that all emails would be examined so his remarks will be officially recorded. I doubt that his rather 'excitable' nature will do him any favours.
