blown over fence

2 years ago i had an argument with the guy from next door as to who ownes the fence, it went to a solicitor and we did it all legal and he wanted it so i let him have it, i wasnt really to fussed to be honest. the argument only started as i stained myside and he kicked off as he thought it was his.

the thing is a dont really like him to much either, eg as soon as the mk comes out the garage hes at the door ready to start moaning about noise

anyway how funny is this its all blown over and he came around this morning to see if i was willing to pay half to replace it, so i reminded me that it was all legal and that it was his at his request lol

what do you think should i pay half ? 10m of proper fencing not pannels

If you went to all that hassle legally then let him pay for it. If he does a rubbish job or doesn't bother put your own up on your side of the boundry.

Personally I would tell him to shove it, then release the hounds.

He went to all that trouble to prove ownership of the fence because you put some preservative on it.

He now owns te fence, he is now responsible for it but has come crawling back now its time to pay up.

He shouldnt get away with it.

Did it blow over onto your side and damage any plants etc?

Id be tempted to pay half as long as you get chance to clear the air with him and set the record straight ref noise etc (ie he keeps himself to himself etc).

Good fencing doesnt have to be expensive if you know where to get the bits from. I would offer to do it if he paid for materials, ie you buy the bits after he has coughed up based on your estimate and then you make something out of it whilst he thinks he has only paid half.

Depends on who's ence it is. Who does the fence on the other side belong to?

Usually one side "belongs" or rather is maintained by one neighbour, usaully by agreement. If he wnet to courts to be legal owner of the fence, then tough.

... but it may be worth having a discussion in case he ut up one that is 20 ft tall - does it block off the sun & are you bothered about what gets erected?

I might partly base my decision on how much it would cost.

I wouldn't be rude about it... it never helps.

But after deliberately going out of his way to claim ownership I would personally let him pay for it. Isn't that why he wanted responsibility for it after all!

Out of interest, is it technically wrong to paint/preservative you own side of a fence you don't own?
If it is wrong but he was so petty about it.... I'd let him pay!

And next storm encourage it with a boot!

It's a tricky one indeed.

If you want to try to be friends then make an offer if not then don't.

As you went about things legally - technically the fence and maintainance is his responsibility, you have no right to even touch, mount hooks, hang plants on the fence.

Personally I'd try to bury the hatchet and make a token gesture of paying for part of the fence. You may need his patience when the 7 is mobile. He may even fancy a go in it! You never know...

For certain he will have to ask your permission for access to preserve your side of his fence.

My cousin had a fence put up with concrete posts and slot in wood panels. Next morning all the panels were gone, they also slot out .

Its his fence. He took legal action to prove his claim.

I wouldnt pay a bloke who made me take up paying a solicitor to sort it out.
It should have been marked on the Deeds whose boundaries are maintinaed by whom.

Its legally his fence, and therefore his responsibility.
It would be an insurance job in my mind. as long as he is covered for that.

it is (was) my fence on the deeds but he kicked up such a fuss about it i said he could have it as i couldnt really give a toss.

the guys a bit of a fruit to be honest. i might pop around tonight and have a go at home as its crushed my plants lol. just to add a bit more fuel to the fire lol

Offer tp pay half and get it in writing that you have made a good will gesture to him. If he kicks off ever again about anything, like your car making a noise, you will be able to show how reasonable a man you are as after all the legal case cost you you still did the neighbourly thing over the fence. That sort of ammunition in hand is priceless should something re ignite his anger.

Tell him to get stuffed and also tell him you are going to claim for your damaged plants and a landscape gardener to do the work!

I'm curious why he's come round to ask.

After the hassle of going to court i wouldn't have the balls to go round and say "want to pay half" - although i know some (ok lots of) people are far thicker skinned than me.

Possibly he can't afford to replace the fence and is eating humble pie faster than desparate dan eats pies.

the one thing to be careful of is if he gets the fence errected, its done exactly how he wants it. I've heard of plenty of stories of a few inches being 'accidentally' being lost when fences are errected.

Perhaps you should go round and have a chat. Explain that after the hassle he caused taking you to court you are under no obligation to pay anything and should technically be putting a claim in for the damage his fence caused to your garden. Obviously you're not that petty and won't do that, so how about a deal, you'll pay a token amount, say 100 / 150 quid and let the fence errectors come onto your side of the boundry, for that you'll get the right to paint your side of the fence & if you need a hand just give me a shout.

how does that sound?

a cheap fence will be one wich is blowing away every moment..

you could also sign with him an agreemant that your side is yours and his is his...

anyway its a b**lch*t thing to talkabout if you have a normal relation ship i mean the otherside of the fence (your side) altough being his he even cant see it..

just been around to see him and i was going to offer £150 towards it, he told me it cost £1500 and thought i was taking the piss.

so told him to pay for it his self and make sure its well within his boundry this time, told him to call the councill but i think its 18"

w4nker.

had a chat with the guy the other side who tells me that no one talks to him

I recently had 100ft of fencing fitted, 6ft high, including taking out a wall, an old fence and 30ft of hedge. It was about 1/3 of that cost from memory. I didn't have the cheap slot in stuff either.

£1500 for a fence? Is it gold plated. If he doesn't replace it I wonder if you get a nice one put up and claim against his house insurance.

Though be careful you have to put any disputes with neighbours on the forms when you sell your house. A sh*t neighbour really puts off buyers.

i have a grumpy old man over the road, technically one of us due to his history of welding and fibreglassing but he is very hard work. Always is rude and ignores my wife etc, pulls his car out to stop people parking opposite, complained that my fence was too plain! D: Take them as they come i guess, he lent me his lawnmower and i broke it
