My son was forced to brake hard whilst on the M6 last w/end but managed to stop. Dozy cow behind thumped him up the back end causing £1k worth of damage to his car. Question is does he put it through his insurance (Elephant) or deal with her insurers direct?
Will it affect his NCB either way?
What do you guys think?

if someone goes into the back of you it is always there fault

he should have all her details and phone his and her insurance company

person behinds fault. Thats the way it works, they should maintain a safe distance behind at any speed to allow for the car in front to emergency stop.

He has to go through his insurance company...they should get all the details from your son and deal with her insurance co re liability, payment, etc.

I didnt go through my insurance when we were hit 6 months back. I told them but when i contacted BMW bodyshop they put me onto their accident management company who dealt with the claim direct to the other persons insurance. I was then able to tell my insurance company i wasnt going through them.

I believe that even the the BMW bodyshop is from the main dealer they deal with repairs for any make. Its worth contacting such a bodyshop to see if they do the same. Best thing for me was they defo do like for like courtesy vehicles. They managed to get me a 320D SE Tourer (newer model than mine) but when i said i didnt want the auto they could get quickly they then let me have a X3 which was great.


As said before i think legally you have to inform your company but you dont have to claim through them.

My understanding was that is the case, unless the person behind argues that you braked unexpectedly hard or when not really required. If that is the case then she would need someone to back her up so i think your son would be safe either way.

I was in a car that went into the back of someone, but it was not the driver of my car that had to cough up! Driver in front slammed his brakes on when he caught sight of a filter light and panicked!

No doubt it was her fault - he had managed to stop - typical Sat. afternoon all nose to tail though he must have allowed enough distance as he didn't hit the one in front. Thanks for the advice guys I'll pass it on to him.

Only way it will affect his NCB is if she's uninsured, you might still be able to claim off her even if uninsured if he has the legal extension on his policy

As said you'll need to go through your insurer who will claim from her insurer. Your NCD will only be preserved if your insurer can claim back all costs from the other insurer but in these circumstances this seems likely.
