
bought some CDs on ebay described as " "All CD's and inlays are in good to excellent condition."
Looking at some they have many scratches, two look like they have been attacked by a sander
but play; 4 of them skip.
So basically trying to get my money back for the faulty and poor ones but seller is saying I should return the lot (about 40) and pay for return
postage.
I am disputing this as items are not as per description so why should I end up out of pocket?
Not had an ebay dispute before but what do I do about getting full refund as well as reimbursement for return postage?
Paid via paypal so will that help me getting money back in full?
Easiest (but maybe not the most honest) solution is to claim none-delivery from Paypal.
Paypal automatically refund if there's no proof of delivery (which is why my ebay posatge is so expensive, I'll only send stuff recorded
now).
Leave it up to the tosspot seller to claim on his postal insurance.....
~^^^ yeah ,that is what I was thinking but obviously I cannot let ebay/apypal know that I received them then try to claim for non received items, hence the question.
Legally speaking you have 2 options;
1) Return the lot for a refund as the "item" as a whole was not as described.
2) Shut up and stop being a cry baby. You got it on ebay cheap cause you were prepared to take a risk right?
If the seller is nice you may convince them to give you a partial refund upon returning the faulty part of the goods.

open dispute stating items are not as described and send pics to ebay.

The only thing I think you can do now is dispute on description.
Claiming they didn't arrive isn't going to fly now.
Unfortunately it has the potential to get ugly if/when the seller claims they were in perfect condition when he sent them.
