
how come pubs are aloud to just fence part of the paths out side the pubs for what seems to be for smokers after years of right of way ?

They usually pay the council to rent part of the payment, we even have to pay the council to put at 'A' board outside our shop on the pavement.

Maybe the landlord has to pay the council to be able to fence off a section of the foot path. If he didn't fence it off then anyone having a drink and a smoke on the foot path would then be drinking off the premises of the pub. Then the land lord would need an off licence as well as an on licence to sell alcohol.
What really boils my p*ss is the amount of tab ends and rubbish they just throw down and leave. And then we all have to pay for the local council to tidy it up (usually a half hearted job in my area)
Annoying too if you don't smoke these days and you wish to enter into a non-smoking shop/pub etc!
Have to walk through a massive cloud of smoke and people, and get in stinking of smoke!

Would be nice if they could devote a smoking area for every establishment so you weren't forced to walk through it in order to get in. Nice but
not realistic...
