Some of you may remember that i ordered a item from additions direct prior to christmas, for the bargin price of £27.00 + £3.50 postage everone else
(argos,boots, john lewis, amazon is selling at £59.00)
this was to be a christmas present and when i ordered it, it was in stock. however to cut a long storey short i still have not received the goods.
They have now just refunded my card and told me to reorder, however they have none in stock and never had any since the day after i ordered mine.
even when they refunded my card they only refunded £27.00 and not the postage .
Anybody looking at this will think Additions have messed up by selling the goods at lower than cost price and i was never going to the goods for the
bargin price.
do i have to accept the money or can i insist on the goods for the advertised price?
any other advice would be welcomed.

for goods ordered off the interent, the point of sale happens at dispatch, not when they 'accept' your order. Hence, there is no contract
of sale. However, you are entitled to a refund of your postage costs. Not sure what legislation applies here, but it always helps to be able to hint
at a law in a letter.
Incidentally, i recently bought a phone from CPW, after my number ported i found i had no reception. They wouldnt accept it back due to it being
outside the 7 day return period. So i wrote a letter to the directors office, mentioning the sale of goods act (specifically, fit for purpose and the
fact that there is no specific time limit on returns). I also asked for a new pac code to port the number off again! They accepted it without
hesitation, gave me the code over phone and agreed to send me a special delievery envelope to return it in.
Quote law, and you will have your way!

Talk to your credit card company, if there is a dispute they normal refund you and chase the company for you.
If they didn't post anything they can't charge you for it.

i have emails confirming that goods have been dispatched.
so there is a contact of sale and therefore i am entitled to the goods,
what happens if they say they have delivered.
