Can you trace phone calls?
Long story short. My sister in law got a phone call from the police tonight to say that her ex husband has complained that she has had abusive phone
calls from her family. We know for a fact that nobody has phoned him. She has sent her lawyer an email but it will be tomorrow before she gets it. We
don't know if the calls were to his home phone or mobile . So the question is,how do we go about proving we didn't make any calls?

Nothing.
Doesn't he have to prove you made the calls?
Let the Police and sols sort it if you know it aint you.

Surely it will be on your sisters phone bill if it is itemised, just use that as proof.

It's logically impossible to prove you didn't do anything. So under law he has to prove you did, as Avoneer says.

All correct, in the words of the law, "The burdon of proof lays with the acuser", i.e. innocence until proved otherwise. Not a very nice
situation to be in but best let the police and lawyers sort it.

First of is she sure it was actually from the Police ?
These days normally all UK phone calls have routing information attached that indicates the number and provider it came from, even if the number is
with held.
Calls from abroad and some private systems don't have this routing information attached. Internet calls also don't have information, which
is why it is so hard to block Mumbai call centres.
With caller ID units often the originating number from international or internet calls just shows as "International" or
"Unavailble".
Where as calls where the caller or private exchange withold the number show up as "Withheld" but the originating number is available to
the Police.

Wouldn't do any good to prove that they didn't make the calls as it could have come from a pay phone! Or am I missing something?

Not sure when this is starting or if its retrospective. Apparantly the law was signed in July so I expect it starts today....
At the very least they could prove if anyone rang them at the times they claim...

We did wonder if it was the police as the number was withheld so we phoned the local station and was told it was them. Just seems strange that they
believed him with no proof. My sister in law was told to ask if anbody had made the calls and to ask them to stop it if they had!!! He probably
couldn't be bothered to come to the house and speak to her as it was almost closing time at the station (must be no crime here after 5
o'clock)

typical police response, they dont know who to believe (after all, they can only go on what they have been told). They contact you to report the
complaint, to give you a chance to stop if you were. Its the easiest way to solve a very minor alleged crime. If he then alledges that the calls have
persisted, they can then investigate knowing they have asked you to desist and there is then a realistic chance of a harrassment prosecution.
Be fair to the cops, they arent mind readers! It will be a bored copper just trying to keep the peace. There is no chance at all of your family being
hassled by the police if they havent done anything.

Don't do anything. Make a record of all calls from the police.
If they make a habit of calling and asking you to stop making calls you didn't make, you have the start of a harrassment case yourself.
