Personal Injury Advise
Hi All,
I am after a quick bit of advice. I got knocked off my motorbike back in Sept 2007 and the bloke accepted full liability straight away (thankfully). I
received whiplash which lasted for about 2.5 months. I did no take anytime of work as I don’t like doing sickies. Further more I received 2 small
scars on my left knee and a small scar on my left elbow. Plus 2 week injury to my left shoulder (muscle) which lessened the range of manoeuvrability I
had in it (only for the 2 weeks).
I have had the doctor report done and yesterday received a settlement figure of £1100. After phoning them today they have upped it to £1350. Does this
sound like a fair offer?
Have any other people had similar situations and what did they receive?
I am dealing direct with his insurance company BTW as I don’t really want too much hassle, I just want a fair offer.

dunno but sounds a bit low .... but bottom line is hom much do you need to complete the kit?
serioulsy though, contact a few of the claims companies to get an idea of what is paid out.

What were you expecting?
Why were you expecting that amount?
What is your view of the offered settlement figure?

Trouble is not taking any time off work will give a lot of problems claiming the whiplash was serious.
To me it sounds fair if not generous. But it's really up to you. Pushing hard for more may require time off to go to court/talk to lawyers not
to mention the stress. Depending on your employer/situation that could end up costing more than any extra you might win.

Forget what any of the online "injury barometers" say as they are just after you going with their solicitor as generally they make as much
as the injury settlement (get paid £1k, and the insurance co will pay £1k in costs too.....roughly).
Remind the insurer you aint gone to a solicitor and have therefore saved them a big wedge and they may go to around £1500 - 1600. TBH i reckon their
settlement is about right.

All very good questions!
I really don't know what I was expecting.
Part of me feels it is not bad and part of me says I want a bit more.
I think I will think about it for a couple of days and then call them back.

Good points. I think I would be happy with £1500 if I am honest.

For a similar injury i got £1600 3 years ago and there is maybe moves to reduce payouts a bit since then.
£1300 doesnt sound too bad. I visitted an osteopath about 4 times and pushed them for more as i was in severe discomfort when travelling with work
(long haul flights etc). If you take off the professional fees from my settlement then £1300 ish sounds about right.
Settlements are of course a personal thig so probs best to take solicitors advice if you have one working for you. If you turn it down its not
guaranteed that they will up the next offer. It may go to an underwriter who may decide your offer was too generous.

sound about right, had a few claims myself in the past.
Note - always take time off work following an accident, you will not be taken seriously otherwise.

Since there is no permanent injury and you didn't lose salary what are you claiming for ?
Shock?
Anything you can get ?

Your settlement takes no account of future possible disablement as a direct result of this accident. If you settle now you will have no comeback in
five years time if you have chronic neck pain and have to wear a collar. A good solicitor would have included an orthopaedic assessment of possible
future disablement. The settlement would still be final, just a bit bigger. Not too late to look at this aspect.

I would suggest a final visit to a suitable doctor, to check if there will be any long-term effects.
In my case, I had 4 or 5 visits to a physio paid for, the bill for the damage to the car settled, and around £1300 on top.

Yeah i'm with you 100%.
In my opinion you should only ask for money if you needed it to become your self after the accident.
saying that a bit of money to be sure in the future could be a good thing. but we all know you will spent it anyway....

I Used to believe people who claim were money grabbers, however after being hit from behind last august i have a different opinion.
For at least 4 months after my back was sore to the point i almost wanted to cry - and i don`t believe in crying!
I still havent got back to the gym, when i do it will take me 6 - 12 months to build up to the point before the accident.
I didn`t go to a doctor as they cannot do anything for a bad back, so i cannot claim. I have lost weeks on my build as a result of working a bit
slower.
All in all i would prefer not to have an accident, rather than a huge setlement. Heath is so easy to take for granted!

he didnt lose salary because he's got a tough attitude, which i would applaud. I have no time for people who pull sickies when they arent
necessary, saying he should get less because he was too stubborn to take time off work is just another way in which the weak are rewarded.
