Ebay trader warning: YESCARPARTS - 7day return policy dishonoured

This abay trader has failed to honour their own '7 day no quibble guarantee' - they even say they will accept back parts correctly supplied.

HOWEVER, I contacted them to return my part and they simply refused!!

I left neg feedback and their reply was I just had to return it............

They left 'positive' feedback for me calling me a liar...ebay have removed this and are now investigating the seller.

So
1) - warning - Yescarparts do not honour
their return policy
2) Yescarparts had 10 negative feedback strikes last month....
3)they leave negative comments in your feedback even when they are deceiving you.
4)Paypal will not dispute the transaction if it is not a problem with the item itself.

Really? On what grounds did they refuse? They are a business and have to accept returns.
Was the item defective, or the wrong part?

Do you have your Paypal account paid for via a Credit Card?? If so then take it up with the credit card company who should be able to help you.

If the part was correctly supplied then they don't HAVE to accept the return. If they have a policy of accepting returns on their ad then of course they should accept it.

This is the thing - there was nothing wrong with the item - I ordered in error, cancelled within 30 minutes, told them not to send it as they have a '100% no quibble ruturn guarantee' - even for parts correctly supplied. - they said they were sending them anyway and they didn't accept returns! .. all very odd indeed.
My paypal was paid out of my bank account so no joy there.

Since this sale would be covered by the distance selling regulations, the supplier is obliged to comply with the law that provides the consumer a 7 day "cooling off" period.

If it was a "buy it now" then they have to honour the 7 day returns to comply with the remote sales laws - same as telesales

Yup. That's true. If it's an auction the 7 day cooling doesn't work but for BIN the cooling-off applies. So either even if they didn't quote a "no quibble guarantee even if the parts are correctly supplied" they'd still have to take them back.....

I checked with the Office of Fair Trading and, yes, they are in breach of the Distance Selling Rules, but, OFT don't get involved so I'd have to take them to court for £64......

Just the threat of court action should illicit a response. Write to them in your best english asking them to refund your money or face court action.
A small claim in court is no hassle to set up if it all goes tits up. The CAB will help with the details.
DON'T LIE DOWN AND DO NOTHING!!!!!
