Problem with DELL XPS Laptop

Ok here is one for the Legal begal;s

Bought a Dell XPS 1330 Laptop May 2008 ago and paid for it on Credit Card - Vai DELL Online.

Jan 09 - Laptop Fails and motherboard is Replaced (Nvida Problem)

June 09 Laptop Fails and requires motherbaord replaced -

Dell say laptop is out of Warranty Replacement cost £413.36


On raising Problem to VP level in Dell I get an answer of "Owe well out of GOOD FAITH we will replace motherboard FOC but you only get 90 days warrenty"

So far I have thretened court Action and am trying to get dell to refund or relace with machine of my choice inc 1 years Warranty. Based on Laptop has inherent problem under Sale of goods regulations 2003....

Q) Do I dig my heals in and hold out and go to court for chance of loosing or do I cut and run and take the fix


Note: Since Laptop failed in June I have bought a Compaq Laptop as I grudged giveing dell £413.36 to fix something that appears to have an inherent problem


See this as backup to the problem

the Nvidia upgrade on my inspirone failed after one year but fortunately I'd extended the warranty. I'd never buy another Dell anything, they are now just cheap tat...

get it fixed. then sell it straight away...

Strangely I also have an HP replacement and it's been excellent.

tells a story!

IIRC the Sale of Goods Act requires stuff to be of merchantible quality. It has to last for a reasonable amount of time for what it is and what it cost.

I.e. you still have rights if a washing machine dies in month 13 as its ludicrous to expect to have to buy a new one every year.

Same deal with a laptop. It won't mean that you get a new one though but they should do something to sort the problem as they have offered.
