10 million could have speeding raps quashed

Over ten million drivers could have their convictions for speeding overturned as a barrister fights a legal battle to prove speed cameras are illegal.

Barrister Michael Shrimpton has argued that all speed cameras are illegal and all prosecutions that rely on both hand-held and fixed cameras have been won on inadmissible evidence.

Car insurance customers may be interested to know that Mr Shrimpton has said that under the Road Traffic Act, each new type of camera that has been introduced since 1991 must be authorised by Parliament.

However, he claims that over 40 devices have been approved by the Home Office and the Association of Chief Police Officers but not by Parliament – which makes them illegal.

Mr Shrimpton argued his case at a court in Kingston, Surrey as he defended a client who was allegedly caught speeding by a laser camera last year.

He has demanded that all cases similar to this one be adjourned until a higher court rules on the debate.

If his bid is successful then it could cause millions of car insurance customers who have been given speeding fines to try to reclaim their money and possible cause embarrassment for the government.

Mr Shrimpton told the Sunday People: "It seems around ten million prosecutions, including fixed penalty cases, have been based on unapproved devices."

However, a Home Office spokesperson told the news source that the cameras were lawful and that there would be "no embarrassment" for the government.

Meanwhile, the Times reports that Scottish ministers are planning to introduce more average-speed cameras across the country.

i've often wondered about the hand held laser guns, how can the police prove (even if they stop you straight away) that 1) the gun was pointing at you, and 2) the speed on the gun wasn't recorded on someone else earlier, if you get the drift.

I've never been done for speeding, so i've never been presented with anything about speeding, so i don't really know how it works

Its a total con mate.
Was done two years ago, 86 in a 60. (dual carriageway, straight road in a rural area), never saw it first till last and knew nothing about it untill the NIP dropped on the door mat. They said they had art so I said send it to me. Was definatly a picture of my car, taken from a low angle to the rear. Car looked parked up! Couldnt see and occupants, let alone make out who they were.

Was hounded all the way, basically they were demanding money with menaces. Send this in or we'll fine you £500, send that in or we'll fine you £1000 etc etc. In the end I fessed up only to find out later that the Li20-20 has been banned in the US for being inaccurate!







If its broke, fix it. If it aint broke, take it apart and find out how it works!

Bummer they really affect your driving style and concentration IMHO a definate need for cruise control if thes becomes common.

moving a laser gun i can make a car not moving parked do 11mph by moving the laser gun about on the car,so if i ever got done i would show them its no 100% and get off with the fine.
