Paypal taken to court
I'm also a member of the penaltycharges forum, set up to help people get bank changes back - they have been very successful. In their latest
newsletter they are taking paypal to court:-
If that's not enough law, then feel free to track the case of Hone v PayPal. Our boss is taking PayPal to court for various reasons including
PayPal meddling in a contract between the buyer and seller!
6. PAYPAL
Court Proceedings have now been issued against PAYPAL an (eBay company)
We have seen a number of complaints against PayPal just refunded buyer money when there has been a contractual dispute between the buyer and selling.
We have asked the court to make a declaration that in contractual disputes between the two parties (buyer and selling) that PayPal has no legal
standing to intervene by refunding the buyer money, clearly is there is a contractual dispute the only person who has the power to order a refunded or
make an award of money is a Judge at a Court of Law.

Whilst I acknowledge that PayPal have gone a little 'crazy' of late, I can say with certainty that had it not been for their
'refund' system, then I would certainly be over a Grand down over various scams, wasters, etc!
I can also be certain that I would not have had the time (or the certainty of actually getting my money back) had I had to seek various refunds
through a small claims court.
Difficult one this!
I'm buying and selling bits on ebay all the time - the potential for me getting stung is huge... am I going to go before a court on every
occasion when I get shafted?

Just looking at the threads paypal have until tomorrow to respond to the court else will loose by default
This case is being brought by Steven Hone who started the penaltycharges forum. He is Managing Director of Legal Advisers Ltd which specialises in
Employment Law and was also the President of the Student Law Society.

To be honest in this case the seller was silly to give into the buyers demands that the guitar be sent (despite being listed as collection only). He
should have just submitted a non-payment claim and left it at that.
