I guess that first thing to check is selector. If poss try adjusting to see if you can get more movement into 5th (ie push it further into gear - could be gears are only just engaging).

If that doesn't work, contact the seller - presumably as it's recon, you bought from commercial outfit. They can then replace it (Sale of Goods Act).

If private purchase then Caveat Emptor and Uberimar Fides(sp?) spring to mind I'm afraid.
