e-bay problem
chrisg - 6/3/08 at 02:05 PM

I've got a little problem with e-bay and I'm not sure what to do.

I bought a part and the seller doesn't take paypal, now he won't send me his address for me to send a cheque, I presume because he doesn't think he's got enough for it.

How do I stand, should I contact e-bay?

Cheers

Chris

balidey - 6/3/08 at 02:13 PM

When you complete the check out you should be given his address then.

onzarob - 6/3/08 at 02:13 PM

Basically he saying he has withdrawn it from sale, I suppose thats ok btter to know now than after he has cashed the cheque.

I do think this is the grey area of ebay, I know its a legal contract etc, but how can you force someone to part with something if they havent even taken the money. I think you'll have to let it go.

Paul TigerB6 - 6/3/08 at 02:24 PM

You could try requesting an invoice. Doesnt this give the postal address??

Does sound like he doesnt want to sell though - maybe he didnt get as much as he wanted for it. If this is the case then i guess all you can do is either forget about it or raise a dispute through ebay

speedyxjs - 6/3/08 at 02:24 PM

Contact ebay and if no help, start a compaint. The sale is a contract, if he doesnt cancel the auction before it ends, he should follow it through

chrisg - 6/3/08 at 02:29 PM

At the checkout it said "address not on file with e-bay" It's his first sale too.

I think I should contact e-bay, just to let them know that he's not reliable.

I realise I'll never get the part but I've had to bite the bullet and let things go for less than I wanted, surely this is why you can set a reserve?

Cheers

Chris

onzarob - 6/3/08 at 02:30 PM

I would still say, if he got the goods and you have the money then he can still withdraw the item for sale.

I would suspect that ebay couldn't make him sell it either, but i doubt they will let him re-advertise it.

chrisg - 6/3/08 at 02:37 PM

I've just checked - He's already re listed it!!!!!

iank - 6/3/08 at 02:39 PM

I'd start a dispute, not that it will get you anywhere.

I would dispute it then. It may get you somewhere

Basic laws for the sale of goods, incorrectly priced you can withdraw it, but if you then try and sell it then it has to be the marked price

chrisg - 6/3/08 at 02:57 PM

If they don't do something and I don't get what I want for my next sale, does that mean that I can simply re list it?

The whole thing would collapse if everyone decides to do it.

I'm bloody fuming

Chris

iank - 6/3/08 at 03:08 PM

As he's effectively cheating them of their fee for setting a reserve they might do something. But I wouldn't put money on anything happening.

balidey - 6/3/08 at 03:26 PM

sounds like you're not going to get it, so lets have some fun.
Post up the link and we can all ask silly Q's, bid it up, then retract bids. And have a final HUUUGE bid from a newly made user ID so he is then charged a massive final fee.

(assuming its not something embarasing?)

jono_misfit - 6/3/08 at 03:42 PM

As above, then you can give him an extra kicking by saying he cashed your cheque and never posted your item, oh and give him negative feedback sayign he stole your money.

I think ebays a crock'o's**te most of the time. If i can avoid it i do.

UncleFista - 6/3/08 at 03:47 PM

There's no legal obligation for the seller to honor a sale on ebay until the money has changed hands (a lot of discussion, but supposedly that's how the law stands).

Report him to ebay for not filling his details in, he'll either have to fill 'em in or be kicked off.

Guinness - 6/3/08 at 04:02 PM

Come on Chris, what was it you wanted?

Or can't you say?

Mike

worX - 6/3/08 at 04:27 PM

I would do this also...
I wouldn't be that quick in sending this person a cheque anyway Chris!

hardassfunk - 6/3/08 at 04:30 PM

Start an item not recieved dispute and leave him negative feedback! that should garantee him not selling the item. he will still be charged the listing fee and Ebays 7.5% final value fee unless you both agree not to go through with the sale

oldtimer - 6/3/08 at 05:27 PM

I know others have asked for a link but where is it?? ... or was it fluffy pink dice or something??!!..............

r1_pete - 6/3/08 at 05:52 PM

Go on, post the link to the relisted item, stupid questions are real fun unless you're on the recieving end...

[Edited on 6/3/08 by r1_pete]

tjoh84 - 6/3/08 at 06:06 PM

you can request adress from ebay support thats what i done before searh it under help on ebay

Jon Ison - 6/3/08 at 06:14 PM

Chris is it something maybe a potential bidder would want to view ?

If so link me the item and I will ask for a postcode, addy so I can view before placing a bid on the item.........

You could always come along with me and a few others to view...........

ReMan - 6/3/08 at 06:23 PM

Scum of the earth!!

Non sellers are worse than non payers in my book.
They have all the time in the world to list the item, set a reserve or starting price and so have much less excuse for not getting as much as they want for an item, than a buyer in the heat of the moment bidding more than they really want to spend.

String them up I say

Seriously I have had more trouble with non sellers than non payers in my 50/50 use of ebay.
Should chase them through ebay as much as possible and as said if not reciept mean they end up paying the fees, thats a good plan too, might stop them doing it again

turbodisplay - 6/3/08 at 06:47 PM

I once sold a 150 quid item that went for 30 on ebay. I honnered the sale, accepted as a risk of no reserve.

chrisg - 6/3/08 at 06:55 PM

Gosh, so many replies!

It's a strap-on... no it's a Focus rear hub!

This is the re listed item.

Spot the difference, nothing from e bay yet

cheers

Chris

Jon Ison - 6/3/08 at 07:39 PM

love this bit.........

SCAMMERS/CLOWNS/NON PAYERS NEED NOT APPLY ,SO IF U DONT HAVE THE FUNDS PLEASE DO NOT BID!

edit to add I have took the liberty to ask a Q ?

Edit to further add, why dont we all bid on it, get it up to a grand ??? ohhhhhh the fee's.

Edit Mk3, don't worry about bidding on it, I'm more than happy to put the last one on, I have a zero feedback account I'm not particulary bothered about, get bidding.

Looks like he's self incriminated himself with an answer. What a cock. So to confuse I've asked the question

Hi is this the left handed version with the right hand thread or the much rare (possibly more expensive) right handed version with the left hand thread. Sorry I should make it clear that its the hub nut thread I'm asking about.

chrisg - 7/3/08 at 07:57 PM

Just got this

"Hello Chris,

Thank you for contacting us regarding your transaction for the hub/abs
sensor (item 120227125504) you've won from "rambo19771978". I am sorry
to hear your seller has relisted the item after you've won it.

As a concerned fellow eBay member Chris, I really understand how
upsetting this can be for you. Please be assured that I will do my best
to help you out with this situation.

Please be aware that since the seller is refusing to sell the item after
you won this item, this is a breach of our Seller Non-Performance
policy. Just as you are obliged to pay for an item you win, the seller
is obliged to sell it to you. To read our policy, copy this link into a
new browser window:

http://pages.ebay.co.uk/help/policies/seller-non-performance.html

There's a couple of things you should do now:

1) Talk to the seller
2) Report the seller non-performance to eBay
3) Leave appropriate feedback for the seller

- Talk to the seller

First of all, if you haven't already done so, we recommend you phone the
seller and talk to them about what's happened. It's likely you'll be
able to work out a solution together. Here's how to request their phone
number:

1. Click "Advanced Search" at the top of the eBay homepage.
2. Click "Find Contact Information" on the left-hand side of the page.
3. Enter the item number for the relevant purchase. You can find the
item number in My eBay. Click "Search".

We'll then send you an automatic email with the seller's contact
details. Please be aware that we'll send the seller your contact details
at the same time. We feel it maintains trust and fairness on eBay if
members are made aware when other members request their contact
information.

- Report the seller non-performance to eBay

If you can't reach the seller or they are still refusing to sell the
item to you, we'll need to see the full details of any emails the seller
sent to you.

Please reply directly to this email pasting the contents and "header" of
the email into your reply. Every email has a hidden header which gives
information about the email sender and recipient and the email's journey
to its destination. We'll use the header information to verify the
source and contents of the email.

Important:
- Please send the contents and "header" even if the email is in My
Messages. To protect your privacy, we can't view the emails in the My
Messages section of your My eBay.
- Don't send us the email as an attachment. To give us added protection
against computer viruses, we never open attachments.

For instructions on how to find the header in various email programs and
systems, copy this link into a new browser window:

http://www.haltabuse.org/help/headers/index.shtml

- Leave appropriate feedback for the seller

If the seller has made it clear that they won't continue with the sale
and isn't communicating with you, you can leave appropriate feedback for
them to let other members know you had a bad experience with this
member. Be clear and professional in your description of what you feel
went wrong.

If the seller should leave negative feedback for you in return, you
should leave a polite response via the Feedback Forum.

Chris, I hope this information is helpful in resolving this matter and
that your eBay purchases run more smoothly in the future.

Kind regards,

Mary Issacs
eBay Trust & Safety"

so I'll give it a try.

Thanks for helping out chaps, I've resited the temptation to bid myself incase he smells a rat.

Cheers

Chris

EDIT: This is the Q&A that Omega mentioned

"Q: Isn't this the item you sold as http://cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&rd=1&item=120227125504&ssPageName=STRK:MEWA:IT&ih=002 How come you have it for sale again?

ReMan - 7/3/08 at 08:38 PM

The bad news is he's cancelled the BIG bids.
The good news is he's listed some more items for sale and breached the "I might take offers" rules. Tw*t.

Schrodinger - 7/3/08 at 09:12 PM

That question was from me!
I'll try another hehehehe

Jon Ison - 7/3/08 at 09:13 PM

just have to put a last minute stealth bid in, unless of course I'm blocked now ?

mistergrumpy - 8/3/08 at 10:28 PM

chrisg - 9/3/08 at 02:31 PM

Cheers

Chris

That is absolutely disgusting, how can I help without hurting my feedback record?
