Scammer has copied my eBay auction

Advertised and subsequently sold an old butchers block, auction finished last Friday.
Got an email from the buyer questioning the item (not at that point paid for) as she's seen
another auction for the same item, using 2 of my 6 photos and a chunk of my description.
It's got two bids on it, I've reported it to eBay and so far it's still active with 23hrs left.

There's no way of contacting the bidders and don't think there's anything else I can do,
so am feeling a bit angry.

Butchers Block
Scammers block

I doubt its a scam on a butchers block, more like he seen yours go and thought I have one in the garage to sell and nicked your photos. If its cash on collection how can he scam anyone ?

Being cheeky and using photos and even descriptions happens loads.

It took me 2 goes to sell a playbook recently, idiot buyers bidding and not paying, Ive changed all my settings now, so unless your all registered with credit cards and paypal you cannot bid on my stuff.

I have also created a new profile for dealing with the idiots who I saved a favourites, just let them sell something im all poised to bid on their crap

You can email them via ebay, whether they replyis another thing...

Ive reported it

As above I would just think they just being lazy and copying yours, must admit I have coppied others discriptions before if its better than I could write, but using photos if not a gineric item bit risky if theirs is in worse condition

I just asked them a question as to why the pictures are the same as an auction that finished last week. Lets see if I get a reply.

If you have taken the photograph the copywrite belongs to you ? and you can complain to ebay about that aswell.
Or is that not the case with Ebay ?

It might be they have just 'borrowed' your photo to save taking one themselves ?

Will be interesting.
I've borrowed pictures before of NEW items, but something quite so unique is a bit odd?

Just had a reply

I asked why the picture was the same as an auction that ended last week,

Here is the reply

Dear robo_woody,

This was because we couldn't get a picture of the one we have as we are selling on behalf of someone

Don't know the answer to that, but they even copied the delivery, maybe worth you sending them a question??.

I have,

"You are using my images and text so are in fact listing an item that is not your to sell. This is breach of copyright and fraud. I have reported this to eBay.

The reply,

"Sorry you feel this way but we was selling the block and we couldn't get pic of block due to the show"

Probably used my text as they are incapable of writing their own !

I suspect that in ebays terms and conditions and photo's and description used also become their property to do with as they see fit - much the same as facebook - photo bucket etc. - They may well not have an issue with another seller using third party photo and descriptions providing the item being sold is "the same"

I have not read therms on this site but the host may also reserve the right with respect to saved images and text etc.

They've editted their listing, big bold text saying it's a similar block.
